1. Legal Information and acceptance
This legal notice regulates the access and use of the Internet portal corresponding to the address: www.beonprice.com (here in after, the “Website”) that BEONPRICE SL mercantile society of Spanish nationality with CIF: B37517844 and social headquarters CL Adaja, nº4, Edificio M2, Oficina 02Sur, Parque Científico de la Universidad de Salamanca, Villamayor, Salamanca (España) PC 37185 Salamanca, and inscribed in the Mercantile Registry of Madrid, sheet SA-14376, book 430 Folio 42 on the Book of societies, available to Internet users.
Access to the website is free of charge except for the cost of the connection via the telecommunications network provided by the service provider contracted by the users. Certain services are exclusive to our clients and their access may be restricted or modified under specific conditions, regulations and instructions which in such case, substitute, complete and/or modify this Legal Notice and must be accepted by the user before the start of the service.
Prices of the services provided by the Service Provider will be indicated in each of the commercial offers that this entity make available to its clients and/or potential customers. The use of the services offered to the users through the Portal is subjected to particular conditions (hereinafter, the “Special Conditions”) that, according to the case, substitute, complete and/or modify this legal notice. Therefore, prior to the use of such services, the user should read carefully the corresponding Particular Conditions.
The use of this Website grants the condition of user of the Site (hereinafter referred to as the ‘User”) and implies the acceptance of all the conditions included in this Legal Notice. The provision of the service of the Portal has a limited duration to the time during which the user is connected to the same or to any of the corresponding services. Therefore, the user must carefully read this Legal Notice each time the use of the portal is intended; as its conditions of use may be modified.
2. Intelectual and industrial property.
All the contents of the Portal, to include but not limited to the texts, photos, graphics, images, icons, technology, software, links and other audiovisual contents or audio, as well as its graphic design and source codes (hereinafter, the “Content”), are the intellectual property of the Provider of services or of third parties. Hence, it must be understood that they are not ceded to the User as are not none of the exploitation rights conferred by the legislation in force in the field of intellectual property, except for those, which are strictly necessary for the use of the Portal.
The trademarks, trade names or distinctive signs are ownership of the Service Provider or third parties and it may not be construed that access to the Portal attribute any right on the trademarks, trade names and/or distinctive symbols.
3. Conditions of use of the Portal
3.1 General
The User commits to make proper use of the Website in accordance with the law and the present Legal Notice. The User will vouch to the Service Provider or any third parties for any damages that may arise as a result of a breach of that obligation.
It is expressly prohibited the use of the Portal for purposes prejudicial to the property or interests of a provider of services or of third parties or that in any way may overload, damage or disable networks, servers and other computer equipment (hardware) or computer products and applications (software) of the Service Provider or of third parties.
3.2 Content
The User commits to make use of the content in accordance with the law and with this Legal Notice, as well as with the other conditions, regulations and instructions which in each case may be applicable in accordance with Clause 1 – special conditions-.
In merely illustrative terms, the user in accordance with the legislation in force, must refrain from:
Reproduce, copy, distribute, make available, publicly communicate, transform or modify the contents except in cases authorized by law or expressly agreed to by Service Provider or by the owner of the rights of exploitation in each case.
Playing or copying the contents for private use that can be considered as Software or database in accordance with the current legislation that applies to the law of intellectual property, as well as its public communication or making those contents available to third parties when these acts necessarily imply reproduction by the user or a third party.
Extract and/or reuse all or a substantial part of the Portal content as well as databases that the service provider makes available to users.
3.3 Introduction of links to the Portal
The Internet user who wants to introduce links from their own web pages to the Website must comply with the conditions set out below and ignorance of these conditions is no excuse for not complying with the responsibilities derived from the general conditions of the law:
The link will only be linked to the home page or main page of the Portal and you will not be able to reproduce it in any way (inline links, copy of the texts, graphics, etc).
In accordance with the applicable legislation, it will be prohibited to set frames or frames of any kind that involve the Portal. It is also prohibited to allow the display of the contents through different Internet addresses to the Portal or when viewed in conjunction with content outside the Portal so that: (I) it can produce, error, confusion or deception in the users about the true origin of the service or content; (ii) imply an act of comparison or unfair imitation; (iii) serve to benefit from the reputation of the brand and prestige of a service provider; or (iv) any other form which is prohibited by the current legislation.
The page from where you enter the link must refrain from expressing any false, misleading, inaccurate or incorrect information on the provider of services, partners, employees, customers or on the quality of the services provided.
Under no circumstances, will it be expressed on the page where the link I located which Service Provider has given its consent for the insertion of the link or otherwise sponsors, collaborates, verifies or supervises the services of the sender.
It is forbidden to use any brand, graphic or mixed or any other distinctive sign of a Service Provider within the page of the sender except in cases allowed by law or expressly authorized by the Service Provider, except for those cases allowed by the law, a direct link with the Portal in the form established in this clause.
The page established by the link must faithfully comply with the law and under no circumstances may provide or link to their own contents or those of third parties that: (I) are illegal, harmful or contrary to morals and good customs (pornographic, violent, racist, etc.); (II) induce or may induce the user the misconception that the Service Provider subscribes, supports, adheres or in any way supports, ideas, manifestations or expressions, licit or illicit of the sender; (III) is inappropriate or not relevant to the activity of a provider of services regarding the place, content and theme of the web page of the sender.
4. Exclusion of liability
4.1 About the service quality
Access to the Portal does not imply any obligation on the part of the Service Provider to control the absence of viruses, worms or any other harmful computer elements. It is the users´ responsibility, in every case to ensure the availability of adequate tools for the detection and disinfection of harmful computer programs.
The Service Provider is not responsible for any damage to the computers of the users or third parties during the provision of the Portal service.
4.2 About service availability
Access to the Portal requires services and supplies from third parties, including transport via telecommunications networks whose reliability, quality, continuity, and operation does not correspond to a provider of services. Therefore, services provided through the Portal may be suspended, canceled or be inaccessible at any time during the provision of the Portal service.
The Service Provider will not be responsible for any loss or damage of any kind to the user that may be cause failures or disconnections in the telecommunications networks that produce the suspension, cancellation or interruption of the Portal service during its use or of a previous character.
4.3 About the contents and services linked through the Portal
The Portal access service includes technical linking devices, directories as well as search tools that allow the user access to other pages and Internet portals (‘Linked Sites’). In such case,s the Service Provider acts as a provider of intermediary services, in accordance with article 17 of the Law 34/2002, of 12 July, on Information Society Services and Electronic Commerce (LSSI). The service provider will only be responsible for the contents and services provided in the sites linked to the extent that the provider has effective knowledge of wrongfulness and has not deactivated the link with the due diligence. On the assumption that the user considers that there is a Linked Site with unlawful or inappropriate content, it may be notified to the Service Provider in accordance with the procedure and the effects established in clause 5, and in any case this communication entails the obligation to remove the corresponding link.
In any case, the existence of Linked Sites must imply the existence of agreements with the owners or persons in charge of the same, nor the recommendation, promotion or identification of Service Provider with the demonstrations, content or services provided.
The Service Provider does not know the content and services of the Linked Sites and therefore is not liable for any damage caused by the wrongfulness, quality, downgrade, unavailability, error and futility of the contents and/or services of the linked sites or any other damage that is not directly attributable to the Service Provider.
5. Communication of illegal and inappropriate activities
In the case that the user or any other user of the Internet is aware that the linked sites refer to pages which content or services are illegal, harmful, denigrating, violent or contrary to morals; or that any of the information included by the users themselves, through the services offered on the Portal, has a code of conduct equal to the described above, you may contact the Service Provider indicating the following:
• Personal information of the individual: name, address, telephone number and email address;
• Description of the facts that reveal the illegal or inappropriate the Linked Site;
• In the case of violation of rights such as intellectual and industrial property, the personal information of the owner of the infringed rights if other than the author. It should also provide the certification attesting to the standing of the holder of the rights and, in its case, proof of representation to act on behalf of the holder when it is a person other than the author; contained in the claim is correct.
• A declaration that the information is accurate.
The reception by Service Provider of the communication provided in this clause will not imply actual knowledge of the activities and/or contents indicated by the caller according to the provisions of the LSSI.
